1. Overview

These Terms govern your access to and use of Verafy’s websites, forms, communications, and investigative/reporting services (the “Services”). By purchasing or using the Services, you agree to these Terms.

2. Services; No Legal Advice; Not a Background Check

Verafy provides investigative analysis and reporting using public information and automated tools. Verafy is not a law firm and does not provide legal advice. Verafy is not a consumer reporting agency and the Services are not background checks. Do not use Verafy reports to make decisions about consumer credit, employment, insurance, housing/tenant screening, or any purpose regulated by the Fair Credit Reporting Act (FCRA) or similar laws.

3. Eligibility & Acceptable Use

You must be 18+ and have a legitimate purpose for using the Services. You may not use the Services to stalk, harass, threaten, dox, discriminate, or otherwise harm any person; to violate any law; to infringe intellectual property or privacy rights; or to interfere with Service operation. Verafy may suspend or terminate access for violations.

4. Your Materials and License to Use

You retain ownership of content you submit (e.g., images, messages, documents). You grant Verafy a non‑exclusive, worldwide license to host, process, analyze, transform, and display your content as reasonably necessary to deliver the Services and customer support, including quality assurance, fraud prevention, and legal compliance.

5. Third‑Party Services

We use third‑party processors and tools. These providers operate under their own terms/policies. We do not control or warrant third‑party systems. You acknowledge your data may be processed by such providers for the limited purposes of delivering the Services.

6. AI‑Assisted and Public‑Source Limitations

Results may involve automated ranking/scoring and data from public sources. We do not guarantee accuracy, completeness, or admissibility. Results should be corroborated independently before reliance. You are responsible for how you use any output.

7. Ordering, Pricing, Refunds

Prices and tiers are listed on verafy.co and may change. Unless otherwise required by law, orders are non‑refundable once analysis begins. If we cannot complete an order for reasons within our control, we may elect to refund or re‑run the analysis.

8. Privacy

Our Privacy Policy describes how we collect, use, and share personal information, including use of third‑party processors and international transfers. By using the Services, you consent to those practices.

9. Data Retention & Deletion

By default, Verafy retains original uploads and derived reports/metadata for 30 days (Quick/Analyze) or 180 days (Report/Legal), subject to legal holds or obligations. You may request deletion at [email protected]. Data previously shared with you or with authorities at your request may not be recallable.

10. Confidentiality

Verafy treats your provided materials and results as confidential and uses them only for delivering the Services, improving safety/quality, legal compliance, and as otherwise authorized by you or required by law.

11. Intellectual Property

We own the Services, reports templates, and site content (excluding your materials). You may use delivered reports for your internal/investigative purposes. Do not copy, redistribute, or resell our service methods or content except as allowed by law or by written permission.

12. Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties (express/implied), including merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant uninterrupted or error‑free operation or accuracy of results.

13. Limitation of Liability

To the fullest extent permitted by law, Verafy and its affiliates, officers, employees, and agents are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits/revenue/data, even if advised of the possibility. Our total liability for claims arising out of or relating to the Services is limited to the amount you paid for the specific order giving rise to the claim.

14. Indemnification

You will defend, indemnify, and hold harmless Verafy and its personnel from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services, your breach of these Terms, or your violation of law or third‑party rights.

15. Changes to the Services or Terms

We may modify the Services and these Terms. Material changes will be posted with an updated effective date. Your continued use after the effective date constitutes acceptance.

This Privacy Policy describes how Verafy collects, uses, shares, and retains information when you visit our site, purchase services, complete intake forms, or receive reports (the “Services”).

2. Information We Collect

• Identifiers & Contact: name, email, phone (optional), order info.
• Uploads & Content: images, documents, message histories, descriptions you provide.
• Derived Data: similarity scores, matches, report summaries.
• Payment Data: handled by Stripe; we receive limited payment metadata (e.g., status, last4, transaction IDs).
• Technical Data: device/browser info, timestamps, page interactions; we may log IP addresses for security, fraud prevention, and consent/audit trails.
• Communications: emails/support messages.

3. Sources

Information comes from you (forms/uploads), automated analysis (e.g., AI similarity scoring), public sources (e.g., websites indexed by search providers), and third‑party processors used to deliver the Services.

4. How We Use Information

• Provide, operate, and improve the Services.
• Process orders and payments.
• Perform analysis and generate reports.
• Communicate with you (status updates, results).
• Prevent fraud and abuse; maintain security and audit trails.
• Comply with legal obligations and enforce our Terms.

5. Sharing & Third‑Party Processing

We share information with service providers who process data on our behalf for limited purposes. We may share information with legal counsel or authorities when reasonably necessary (e.g., suspected fraud, threats, or as you request).

5. International Transfers

We are U.S.‑based and may process or store data in the U.S. and other countries where our providers operate. By using the Services, you consent to transfers outside your country, which may have different data protection laws.

6. Retention

By default, we retain uploads and derived data for 30 days (Quick/Analyze) and 180 days (Report/Legal), unless a longer period is required by law, needed for dispute resolution, or subject to a legal hold. We may retain minimal transactional records (e.g., receipts, logs of consent) for longer as required by tax/audit/security obligations.

7. Your Choices & Rights

• You may request access, correction, or deletion of your personal information by contacting [email protected].
• You may request we cease further processing of your materials, subject to legal/contractual limits.
• California (CCPA/CPRA) and other jurisdictions may grant additional rights; we will honor applicable requests after verifying your identity.

9. Security

We employ administrative, technical, and physical safeguards, including encryption in transit, access controls, and least‑privilege practices. No method is 100% secure; we cannot guarantee absolute security.

10. Children’s Privacy

The Services are intended for users 18+. We do not knowingly collect personal information from children. If we learn we have collected such data, we will delete it.

11. Automated Decision‑Making

We use automated tools to rank or score potential matches. These outputs can be uncertain or incomplete and must be corroborated by human review. We do not make legal or eligibility decisions based solely on automated processing.
